FTC "Red Flag" Enforcement Date Extended to May 1, 2009
But Delaying Implementation Of Program May Not Relieve Financial Liability

The Federal Trade Commission (FTC) has suspended enforcement of the “Red Flag” Rules until May 1, 2009, to give creditors and financial institutions additional time to implement identity theft programs.

However, the enforcement delay may not relieve a business from financial liability to a customer whose identity is stolen and the business did not have a Red Flag program in place by Nov. 1. Also, certain rules governing the issuance of calling cards and the use of credit reports will apparently become effective Nov. 1 without an enforcement delay. 

Under the new rules, all businesses that maintain a creditor-debtor relationship with customers, including virtually all telecommunications carriers, must adopt written procedures designed to detect the relevant warning signs of identify theft, and implement an appropriate response. 

The Red Flag compliance program must be in place by Nov. 1, 2008.  But the FTC will not enforce the rules until May 1, 2009, meaning only that a business will not be subject to enforcement action by the FTC if it delays implementing the program until May 1.

Seattle Police Department New Policies

CSAA recently received a request from the Seattle Police Department to distribute to our members the following information linked here.

The letter to the alarm industry includes new requisites for responding to alarms, including the need for a permit number/Unique Identifying Number (UIN), the requirement of using enhanced call verification (ECV), and others. The new policies will become effective on January 1, 2009.
